Privacy Policy
The following privacy policy provides information about the nature, extent and purpose of the collection and use of personal data by the website operator www.ticketcontrol.ch (hereinafter also «TicketControl» or «Portal»).
TicketControl facilitates communication between passengers without a valid ticket, the collection agency of PostBus Ltd (herein-after also «PostBus») and the fare dodger register in accordance with Art. 20a of the Passenger Transport Act (PTA).
Communication with the collection agency
PostBus Ltd’s collection agency is responsible for processing the claims arising from journeys made without a valid ticket in vehicles belonging to PostBus Ltd and certain other transport companies. As a customer, you can contact the collection agency, request an extension of the collection period, arrange to pay in instalments, present a travelcard or pay fees by entering the document number via this portal.
Presenting a travelcard
If you are a passenger from other transport companies (whose payment collection is not recognized by PostBus Ltd), you can present your personal travelcard, if you have forgotten it, within 10 days via TicketControl. If the travelcard is presented within the required time period and the presentation fee is paid, the data in the national fare dodger register will be deleted in accordance with Art. 20a of the PTA.
1. Who is responsible for data processing?
PostBus Ltd is the operator of this website and the controller of the data processing.
This website serves as a communication channel between you, PostBus Ltd’s collection agency, other transport companies that outsourced their payment collection to PostBus Ltd and the fair dodger register. In both of the latter cases, PostBus Ltd is the sole data processor and the respective transport companies (with regard to payment collection) or the totality of all transport companies from Direct Service (with regards to the fare dodger database) are controllers in accordance with Art. 5 of the Data Protection Act (FADP).
If you have any concerns relating to data protection law in connection with the operation and use of ticketcontrol.ch, you can contact us at the following address: PostBus Ltd, "SynServ", Pfingstweidstrasse 60b, CH-8080 Zurich, synserv@postbus.ch.
The website contains links to other websites and services (e.g. payment service providers). In line with data protection law, the respective operators are the controllers for the linked websites and associated services.
2. What data do we collect?
You can use all of the information provided on our website anonymously. However, in order to transmit content, information about the device you are using and its IP address are processed and logged automatically. If you want to contact us via the website, you must provide us with your personal data. We process this data and other data if required. This includes data from the following sources:
- Collected data
When you visit our digital presence, some technical data is automatically collected (such as the IP address of the device making the request, the date and time the website was accessed, the browser used). If you do not register the document number with us or transmit information to us in any other way, the only data collected is the data that your browser sends to our systems. One of the tools we use to collect data is cookies that are necessary for technical reasons.
- Disclosed data
It is an organizational necessity when using our services on ticketcontrol.ch/en that you provide us with information directly or indirectly (via a sales outlet from another transport company), which includes document number, as well as data about you, a specific payment collection or inspection incident, subscriptions or contracts, payment methods, and general information relating to your enquiry.
- Received data
We may also receive data on fare dodging incidents from other transport companies. Smaller transport companies manually file incidents within a protected area via a corresponding tool. In doing so, incident data (such as incident ID, the travel company, the inspection company, the submitting company, inspection date, route or route number, inspection stop, destination stop, reason for objection, potential subscription) as well as details about the passenger (name, date of birth, home town, type of ID, ID document number, address data) is processed.
3. How do we use your data?
All personal data is processed for the following purposes only:
- Using the digital presence:
In order to ensure that the website functions smoothly, for example, that the website is displayed on your device without errors [establishing a connection, ensuring the website functions smoothly, providing services and login function, managing the web pages internally (technical administration)], we need to process your data for technical reasons.
- Communication:
This website serves as a communication channel between you, PostBus Ltd’s collection agency, other transport companies that outsourced their payment collection to PostBus Ltd and the fair dodger register. For communication purposes, we process, in particular, the content of the communication, your contact details and marginal data on the communication.
- Processing your enquiry:
If you do not present your individual monthly or annual travelcard, your Half Fare Travelcard or GA Travelcard at ticket inspection, you can upload it or settle the claim directly via the Portal. If you do this, data such as contact information, the content of communications or information about contracts is processed.
- Compliance with regulations/revenue protection:
We obtain and process personal data to comply with applicable laws (including the Passenger Transport Act) and to provide the revenue protection in connection with it.
4. Will we share your data with anyone else?
In connection with the purposes outlined in section 3, we send your data to third parties, insofar as this is permitted, because they process the data on our behalf or even because they want to use them as a controller for their own purposes. This pertains, in particular, to the following third parties:
- Service providers
We work with service providers who process data, which they received from us or collected for us, on our behalf (e.g. IT providers) or under their own responsibility (payment service providers).
External service providers who process data on our behalf are contractually obliged to comply with the relevant data protection provisions.
- Other transport companies
We disclose data to other transport companies that are part of the National Direct Service if the payment collection is undertaken by the other transport company itself. In this case, information is transferred about the presenting of the travelcard.
- Fare dodger register
In addition, all relevant information (in particular the presentation of a valid travelcard) is transferred to the fare dodger register and is processed there in accordance with legal requirements. The fare dodger register is the national information system on passengers without valid tickets as per Art. 20a of the Passenger Transport Act (PTA). All passengers without a ticket travelling on public transport in Switzerland are centrally registered on this for two years. Those who repeatedly dodge fares can therefore be recognized by the respective transport company. The transport companies who participate in the Direct Service, represented by the StAD (Strategische Ausschusses direkter Verkehr – Strategic Committee on Direct Service), have jointly tasked PostBus Ltd with managing the fare dodger database. The individual transport companies that gather the data are the data owners.
5. Does PostBus Ltd use cookies?
We only use functionally necessary cookies. Without functional cookies, we cannot operate our solutions. These cookies are strictly necessary for the operation of our digital presence.
6. How long is data processed for?
TicketControl is just a communications platform. We process data on TicketControl only for as long as necessary and we handle it confidentially. Immediately after the communication has been processed, the data is transferred to the fare dodger database and/or the collection system and is processed there in accordance with legal requirements.
7. Your rights
You have the right to request information concerning the processing of your personal data. You also have the right to have your data deleted or destroyed. You may forbid or block the processing of your data, provided it is not necessary to render the services you have requested. You also have the right to have incorrect personal data corrected. If neither the correctness nor the incorrectness of the data can be determined, you may request that a note of objection be added. If you have expressly consented to further data processing, you may revoke this at any time. The legality of the data processing for the entire duration of the valid consent is not affected by this. All legal provisions which oblige or entitle PostBus Ltd to process or disclose data remain reserved. If the deletion of the data is not permitted for legal reasons or there is a legitimate reason for the processing of data, the data will be blocked instead of deleted.
